Fraudulent ID or DL Cancellation

If the Secretary of State finds that fraud has been committed, they can cancel, revoke or suspend a driver’s license, ID card or permit.

For most cases, the offenses fall into one of the following:

  • A driver’s license or ID card was obtained fraudulently, making the person appear older
  • A driver’s license, ID card or permit was given to someone else to use
  • A driver’s license, ID card or permit was used fraudulently
  • A false statement or false affidavit was submitted when applying for a driver’s license or permit

  • A person used another person to apply for their driver’s license, ID card or permit

If one of these offenses are committed, the penalties are:

  • For the first offense, a 12-month suspension is issued
  • For the second or subsequent offense, the license is revoked

There are some situations in which a driver’s license, ID card or permit was issued to a driver who used a false identify or a false social security number, and in those situations, the Secretary of State will issue a cancellation and the person will be required to appear before an investigator with the Secretary of State Police in order to prove their real identify before they enter a revocation or suspension. The driver may be able to apply for a restricted driving permit while they are suspended if they go through an administrative hearing with the Secretary of State.
